1. Scope and who we are
This Privacy Policy explains how Skylixor, LLC, doing business as UnDelay ("UnDelay," "we," "us," or "our"), collects, uses, discloses, retains, and otherwise processes information in connection with our websites, dashboards, applications, APIs, airport and transportation tools, artificial intelligence features, and related services (collectively, the "Services").
This Policy applies when you use or interact with:

www.undelayapp.com, undelay.app, www.undelaydashboard.com, and any UnDelay subdomain or branded portal that links to this Policy;

the UnDelay virtual taxi queue, taxi parking, dispatch, geofencing, reporting, invoicing, mapping, and airport-operations tools;
-
UnDelay AI and generation tools, including pricing model generation, public-sector pricing, RFI/RFQ/RFP workflows, public-company comparisons, revenue projections, app and web generation, and related features;
-
mobile applications, integrations, APIs, customer-support channels, demonstrations, beta programs, events, and other services that reference this Policy.
This Policy does not apply to a third-party service, website, or application that has its own privacy policy. A separate written agreement, order form, data processing addendum, airport agreement, prime-contractor agreement, or government contract may modify how we process data for a particular customer. If there is a conflict, that written agreement controls for that customer to the extent of the conflict.
2. Our role and customer-directed processing
UnDelay may process information in more than one legal role. For account administration, billing, security, product analytics, direct customer relationships, and improvement of the Services, UnDelay generally determines the purposes and means of processing. For information that an airport authority, government entity, transportation company, prime contractor, or other organizational customer submits to or directs through the Services, that organization may be the business or controller and UnDelay may act as its service provider or processor.
Organizational customers are responsible for providing any notices, obtaining any permissions or consents, and establishing any lawful basis required for the personal information they submit or direct us to process. Taxi operators, drivers, employees, contractors, and other end users may also need to contact the relevant airport or organizational customer to exercise rights relating to customer-controlled data.
3. Information we collect
Depending on the Services you use, we may collect the following categories of information:

Account and profile information, such as name, email address, telephone number, username, authentication credentials, organization, job title, role, account permissions, profile image, and communication preferences.

Airport and transportation information, such as airport affiliation, taxi or transportation company, operator or driver identifiers, permit or medallion information, vehicle make and model, vehicle number, license plate, parking spot, queue position, dispatch status, route status, entry and exit events, violations, suspension or removal events, and communications with airport personnel.

Location information, including precise or approximate device location, GPS coordinates, geofence events, proximity to airport zones, route and movement information, timestamps, and location-derived operational records. Some virtual taxi queue features may not work without location permissions.

Operational and service-generated information, such as queue events, parking and staging records, dispatch events, admin actions, reports, audit trails, performance metrics, estimated wait times, utilization, operational analytics, and other data generated through the operation of the Services.

AI inputs and customer content, such as prompts, instructions, uploaded documents, spreadsheets, images, screenshots, videos, URLs, website content, public-sector documents, RFI/RFQ/RFP materials, pricing assumptions, business information, government information, app configurations, source data, comments, feedback, and other content you submit.

AI and platform outputs, such as generated pricing models, recommendations, reports, summaries, comparisons, revenue projections, app configurations, code, workflows, analyses, scores, classifications, and other generated content.

Payment and subscription information, such as plan, credit balance, purchase history, invoices, billing address, transaction records, and limited payment-related information. Payment card details are generally processed by our payment processors rather than stored directly by UnDelay.

Device, log, and usage information, such as IP address, device identifiers, browser type, operating system, referring page, access times, pages and features used, clicks, searches, crash reports, diagnostic data, performance data, cookie identifiers, and security events.

Communications and support information, such as emails, text messages, phone or video call information, support requests, survey responses, event registrations, and records of communications with us.

Information from customers, partners, and third parties, including airport authorities, transportation companies, authorized administrators, identity and authentication providers, payment processors, mapping providers, public databases, public websites, integrations, and other sources you authorize.
Please do not submit Social Security numbers, full payment card numbers, health information, biometric identifiers used for identification, classified information, export-controlled information, or other highly sensitive information unless UnDelay has expressly agreed in writing to support that information and you are authorized to provide it.
4. How we use information
We may use information to:

provide, operate, host, maintain, configure, personalize, and support the Services;

create and manage accounts, authenticate users, assign permissions, and maintain security;

operate virtual taxi queues, geofences, parking and staging areas, dispatch workflows, airport dashboards, invoicing, reports, alerts, and communications;

generate AI outputs, process prompts and files, create pricing models and workflows, and deliver requested analyses or applications;
-
monitor operations, troubleshoot errors, prevent fraud and abuse, investigate incidents, enforce airport rules and customer policies, and protect users, customers, airports, and the public;
-
process subscriptions, credits, invoices, payments, refunds when applicable, and related accounting and tax obligations;
-
communicate about accounts, service changes, support, security, customer success, sales, events, and marketing, subject to your choices and applicable law;
-
conduct analytics, benchmarking, testing, research, product development, and quality assurance;

train, evaluate, fine-tune, and improve machine learning and artificial intelligence systems, models, prompts, templates, workflows, and features, as described below;

create aggregated, statistical, inferred, or de-identified data and use it for business, research, benchmarking, safety, commercial, and product-development purposes;

comply with contracts, court orders, subpoenas, public-records and records-retention requirements, procurement requirements, legal obligations, and requests from lawful authorities;

establish, exercise, or defend legal claims, complete corporate transactions, and otherwise operate our business.
5. Artificial intelligence, generated content, and model improvement
The Services may use machine learning and artificial intelligence models provided by UnDelay or third-party providers. Prompts, files, URLs, screenshots, source data, generated outputs, ratings, corrections, feedback, and related metadata may be processed by those providers and by UnDelay to provide the Services.
Unless a written enterprise agreement, data processing addendum, order form, or product setting expressly states otherwise, UnDelay may use customer content, prompts, outputs, feedback, and usage data to evaluate, train, fine-tune, test, secure, and improve the Services and related models. We may also use human reviewers or contractors under confidentiality obligations for quality assurance, support, safety, and model evaluation.
AI outputs may be inaccurate, incomplete, outdated, duplicative, or unsuitable for your circumstances. They are not legal, tax, accounting, investment, procurement, engineering, transportation-safety, or other professional advice. You are responsible for human review and for decisions made using AI outputs.
6. Legal bases for processing outside the United States
Where the European Economic Area, United Kingdom, Switzerland, or another jurisdiction requires a legal basis, we rely on one or more of the following: performance of a contract; steps requested before entering a contract; compliance with legal obligations; consent; protection of vital interests; performance of a task in the public interest where applicable; and legitimate interests, such as operating, securing, improving, and supporting the Services, preventing fraud, and managing our business, provided those interests are not overridden by your rights.
You may withdraw consent when processing is based on consent. Withdrawal does not affect processing that occurred before withdrawal or processing based on another lawful basis.
7. How we disclose information
We may disclose information to:

airport authorities, government entities, transportation companies, prime contractors, authorized administrators, dispatchers, operations staff, law-enforcement or security personnel, and other users as necessary to operate the applicable service or as directed by the organizational customer;

cloud hosting, storage, database, authentication, cybersecurity, analytics, mapping, communications, customer-support, payment, accounting, development, testing, and professional-service providers;
-
artificial intelligence and machine learning providers that process prompts, files, and outputs;
-
business partners and integration providers when you request or authorize an integration or joint service;
-
law enforcement, regulators, courts, government bodies, or other parties when we believe disclosure is required or permitted by law, necessary to protect rights or safety, or needed to investigate fraud, abuse, security incidents, or violations;

prospective or actual buyers, investors, lenders, insurers, advisers, and other parties involved in a merger, financing, acquisition, restructuring, bankruptcy, sale of assets, or similar transaction;

other parties at your direction, with your consent, or as otherwise described when the information is collected.
We may disclose aggregated or de-identified information that is not reasonably capable of being linked to an individual, subject to applicable law and contractual restrictions.
8. Data rights, ownership, and licenses
Privacy laws generally regulate personal information and may provide individuals with rights that cannot be eliminated by contract. This Privacy Policy does not claim ownership of an individual as a person and does not waive non-waivable statutory rights.
The allocation of intellectual-property and contractual rights in customer content, service-generated data, and generated outputs is described in the UnDelay Terms of Service and any applicable customer agreement. In general, users retain rights in their pre-existing content, while granting UnDelay broad rights to host, process, use, reproduce, modify, create derivative works from, and otherwise use that content to provide, protect, operate, improve, and develop the Services.
To the maximum extent permitted by law and subject to any controlling written customer agreement, UnDelay owns the Services and all service-generated data, operational metadata, queue and dispatch event structures, platform analytics, system logs, benchmarks, model improvements, generated outputs, derived data, aggregated data, and de-identified data. UnDelay may retain and use aggregated, de-identified, and model-improvement data indefinitely, provided it is handled in accordance with applicable law.
9. Cookies, analytics, and similar technologies
We and our service providers may use cookies, local storage, pixels, software development kits, and similar technologies to keep users signed in, remember preferences, measure use, diagnose errors, secure the Services, conduct analytics, and support marketing. You can control many cookies through your browser or device settings, although blocking required cookies may prevent parts of the Services from working.
We do not sell personal information for monetary consideration. Certain disclosures through analytics or advertising technologies may be treated as a "sale" or "sharing" under some state laws even when no money changes hands. Where applicable, you may request to opt out by contacting us at contact@undelayapp.com. We will process legally valid opt-out requests as required by law.
10. Retention
We retain personal information for as long as reasonably necessary for the purposes described in this Policy, including the duration of an account or customer relationship and any additional period needed for operations, safety, dispute resolution, security, audits, tax, accounting, public-records obligations, records retention, contract enforcement, or legal compliance.
Retention periods vary by category and customer. Airport, taxi queue, dispatch, location-derived, invoice, and audit data may be retained under the applicable airport or customer retention schedule. Backup copies may remain for a limited period after deletion. When information is no longer needed, we may delete, anonymize, or de-identify it, unless law or contract requires continued retention.
Aggregated, de-identified, statistical, derived, model-improvement, and service-generated data that no longer identifies an individual may be retained and used indefinitely, subject to applicable law.
11. Security
We use administrative, technical, and physical safeguards designed to protect information, such as access controls, authentication, logging, encryption where appropriate, vendor management, and security monitoring. No system, transmission, or storage method is completely secure, and we cannot guarantee absolute security.
You are responsible for maintaining the confidentiality of credentials, using secure devices and networks, limiting account access, promptly removing former personnel, and notifying us of suspected unauthorized access.
12. Your choices and privacy rights
Depending on your location and applicable law, you may have the right to:

request access to or confirmation of personal information we process about you;

request correction or deletion of personal information;

receive a portable copy of certain personal information;

object to or restrict certain processing;
-
withdraw consent where processing is based on consent;

opt out of certain sales, sharing, targeted advertising, profiling, or automated decision-making;

limit certain uses or disclosures of sensitive personal information;

appeal a decision on a privacy request; and
-
not be discriminated against for exercising applicable privacy rights.
To submit a request, email contact@undelayapp.com with the subject line "Privacy Request" and describe your request. We may need to verify your identity and authority. An authorized agent may submit a request where permitted by law, but we may require proof of authorization. If data is controlled by an airport or other organizational customer, we may direct your request to that customer or assist the customer in responding.
You may unsubscribe from marketing emails through the link in the message. You may stop marketing text messages by replying STOP. Service-related and security communications may continue.
13. U.S. state privacy disclosures
In the preceding twelve months, we may have collected the following categories of personal information, depending on the Services used:

Identifiers and customer-record information, including names, contact details, account identifiers, driver or operator IDs, vehicle identifiers, and billing information;

Commercial information, including subscriptions, credits, transactions, invoices, and purchase history;

Internet or electronic network activity, including device, browser, log, usage, and interaction data;

Geolocation data, including precise geolocation and geofence events used for taxi queue and airport operations;
-
Audio, visual, or similar information, including uploaded images, screenshots, video, support recordings, and license-plate images where enabled;

Professional or employment-related information, including organization, role, title, and airport affiliation;
-
Inferences, recommendations, scores, analytics, and generated outputs derived from other information;
-
Sensitive personal information, including precise geolocation, account credentials, and certain government-issued or vehicle-related identifiers when provided.
We collect these categories from individuals, organizational customers, authorized administrators, devices, public sources, service providers, partners, and integrations. We use and disclose them for the business and commercial purposes described in this Policy. Recipient categories are described in the section "How we disclose information."
We do not knowingly sell or share the personal information of individuals under sixteen for cross-context behavioral advertising. We do not use sensitive personal information to infer characteristics about individuals except as permitted by law and necessary for the Services.
14. Precise location and virtual taxi queue notice
The virtual taxi queue and certain airport tools may collect precise location continuously or periodically while the feature is in use, including when the app is in the background if you grant that permission. Location may be used to confirm entry into or exit from airport zones, assign queue or parking status, detect route or geofence events, support dispatch, prevent fraud, enforce airport rules, create operational reports, and protect safety and security.
Location information may be visible to or shared with the relevant airport authority, transportation company, dispatcher, administrator, security personnel, and other authorized users. You can change location permissions through your device settings, but doing so may prevent use of the taxi queue or other location-dependent features.
Where required, we will provide an additional just-in-time notice and request permission before collecting precise location. Organizational customers are responsible for any additional workplace, fleet, labor, or local-law notices required for their users.
15. Government customers, public records, and legal process
Information submitted to, generated for, or maintained on behalf of a government entity, airport authority, public agency, or public institution may be subject to public-records, freedom-of-information, audit, procurement, records-retention, discovery, or other legal requirements. UnDelay cannot guarantee that information submitted in that context will remain confidential or be exempt from disclosure.
We may preserve and disclose information in response to lawful process, contractual obligations, government requests, emergency circumstances, safety concerns, or investigations. Government and airport customer agreements may impose additional requirements or restrictions.
16. Children
The Services are designed for businesses, government entities, airport personnel, transportation operators, and adults. They are not directed to children under thirteen, and we do not knowingly collect personal information directly from children under thirteen without legally required authorization. If you believe a child has provided personal information, contact us so we can investigate and take appropriate action.
17. International transfers
UnDelay is based in the United States. Information may be processed and stored in the United States and other countries where we or our providers operate. Those countries may have different privacy laws. Where required, we use recognized safeguards for international transfers, such as contractual protections or other lawful transfer mechanisms.
18. Changes to this Policy
We may update this Policy to reflect changes in the Services, technology, law, or our practices. We will post the updated version and revise the "Last updated" date. If a change materially affects how we use previously collected personal information, we will provide additional notice or obtain consent when required by law.
